A Summary of Your Rights Under the Fair Credit Reporting Act

The federal Fair Credit Reporting Act (FCRA) promotes the accuracy, fairness, and privacy of information in the files of consumer reporting agencies. There are many types of consumer reporting agencies, including credit bureaus and specialty agencies (such as agencies that sell information about check writing histories, medical records, and rental history records). Here is a summary of your major rights under the FCRA.   • You must be told if information in your file has been used against you. Anyone who uses a credit report or another type of consumer report to deny your application for credit, insurance, or employment – or to take another adverse action against you – must tell you, and must give you the name, address, and phone number of the agency that provided the information.
  • You have the right to know what is in your file. You may request and obtain all the information about you in the files of a consumer reporting agency (your "file disclosure"). You will be required to provide proper identification, which may include your Social Security number. In many cases, the disclosure will be free. You are entitled to a free file disclosure if:
    • a person has taken adverse action against you because of information in your credit report;
    • you are the victim of identity theft and place a fraud alert in your file;
    • your file contains inaccurate information as a result of fraud;
    • you are on public assistance;
    • you are unemployed but expect to apply for employment within 60 days.

  • You have the right to ask for a credit score. Credit scores are numerical summaries of your credit-worthiness based on information from credit bureaus. You may request a credit score from consumer reporting agencies that create scores or distribute scores used in residential real property loans, but you will have to pay for it. In some mortgage transactions, you will receive credit score information for free from the mortgage lender.
  • You have the right to dispute incomplete or inaccurate information. If you identify information in your file that is incomplete or inaccurate, and report it to the consumer reporting agency, the agency must investigate unless your dispute is frivolous. See www.ftc.gov/credit for an explanation of dispute procedures.
  • Consumer reporting agencies must correct or delete inaccurate, incomplete, or unverifiable information. Inaccurate, incomplete or unverifiable information must be removed or corrected, usually within 30 days. However, a consumer agency may continue to report information it has verified as accurate.
  • Consumer reporting agencies may not report outdated negative information. In most cases, a consumer reporting agency may not report negative information that is more than seven years old, or bankruptcies that are more than 10 years old.
  • Access to your file is limited. A consumer reporting agency may provide information about you only to people with a valid need – usually to consider an application with a creditor, insurer, employer, landlord, or other business. The FCRA specifies those with a valid need for access.
  • You must give your consent for reports to be provided to employers. A consumer reporting agency may not give out information about you to your employer, or a potential employer, without your written consent given to the employer.   • You may limit "prescreened" offers of credit and insurance you get based on information in your credit report. Unsolicited "prescreened" offers for credit and insurance must include a toll-free phone number you can call if you choose to remove your name and address from the lists these offers are based on.   • You may seek damages from violators. If a consumer reporting agency, or, in some cases, a user of consumer reports or a furnisher of information to a consumer reporting agency violates the FCRA, you may be able to sue in state or federal court.

LendSure Dispute Resolution Agreement

In consideration for being considered for hire with LendSure Financial Services, Inc. (Company), both Company and the individual named below (Applicant) agree to resolve any and all disputes between them arising out of or in any way related to Applicant’s application for hiring by Company or, if hired, the engagement relationship, including any disputes upon termination, by binding arbitration before a single neutral arbitrator as the sole and exclusive remedy of the parties. The disputes subject to this Agreement include, but are not limited to, all potential claims relating to hiring and termination of services, such as breach of contract, tort, discrimination, harassment, wrongful termination and claims for violation of any local, state or federal law, statute, regulation or ordinance or common law to the fullest extent permitted by law. It includes all claims against any employee, officer, director, trustee, agent, successor or assign of Company which arise out of or relate to their actions on behalf of Company. The parties understand that, by entering into this Agreement, both parties are giving up their constitutional right to have any such dispute decided in a court of law, and if applicable, before a jury, and instead, agree to the use of binding arbitration pursuant to the procedures referenced in this Agreement.

Either party may exercise the right to arbitrate by providing the other party with written notice of any and all claims forming the basis of such right in sufficient detail to inform the other party of the substance of such claims. In no event shall the request for arbitration be made after the date when institution of legal or equitable proceedings based on such claims would be barred by the applicable statute of limitations.

The arbitration will be conducted in the city and state where the Applicant applied for hire by Company or, if hired, where the Applicant was last engaged by Company and will be held before a single neutral arbitrator agreed upon by the parties. The arbitration will be governed and conducted in accordance with the then current applicable rules of the American Arbitration Association ("AAA") (available on-line at www.adr.org). The parties are entitled to representation by an attorney or other representative of their choosing. The arbitrator shall have the power to enter any award that could be entered by a judge of the state court or United States District Court where the arbitration is conducted, as applicable to the claim, and only such power, and shall follow the law. The award shall be issued in writing and state the essential findings and conclusions on which such award is based. The parties agree to abide by and perform any valid award rendered by the arbitrator, and judgment on the award may be entered in any court having jurisdiction thereof.

Company shall bear the costs of the arbitrator, forum and filing fees. Each party shall bear its own respective attorneys’ fees and all other costs, unless otherwise required or allowed by law and awarded by the arbitrator.

In the event any provision of this agreement is found to be unenforceable by an arbitrator or court of competent jurisdiction, such provision shall be deemed modified to the extent necessary to allow enforceability of the provision as so limited, it being intended that the parties shall receive the benefit contemplated in this Agreement to the fullest extent permitted by law. If a deemed modification is not satisfactory in the judgment of such arbitrator or court, the unenforceable provision shall be deemed deleted, and the validity and enforceability of the remaining provisions shall not be affected thereby. The parties agree that this agreement shall be binding on, and inure to the benefit of, their successors, heirs and/or assigns.

This Agreement constitutes the entire agreement between the parties relating to this subject matter and supersedes all prior or contemporaneous inconsistent agreements.

 

Lendsure Application Terms and Conditions

I hereby certify that I have not knowingly withheld any information that might adversely affect my chances for hire and that the answers given by me are true and correct to the best of my knowledge. I further certify that I, the undersigned applicant, have personally completed this application. I understand that any omission or misstatement of material fact on this application or on any document used to secure hiring may disqualify me from hiring consideration or, if hired, may subject me to immediate termination, regardless of the time elapsed before discovery.

I hereby authorize LendSure Financial Services, Inc. to thoroughly investigate my references, work record, education and other matters related to my suitability for hire and, further, authorize my former employers to disclose to the Company any and all letters, reports and other information related to my work record, without giving me prior notice of such disclosure. In addition, I hereby release the Company, my former employers, and all other persons, corporations, partnerships and associations from any and all claims, demands or liabilities arising out of or in any way related to such investigation or disclosure.

I understand that my hiring by LendSure Financial Services is contingent upon passing the background investigation.

I understand that nothing contained in the application or conveyed during any interview which may be granted is intended to create an employment contract between me and the Company.
